            Important: By downloading, installing, or using the Learn Spanish mobile application, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the app.
        

1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Morpich Design ("Company," "we," "us," or "our") regarding your use of the Learn Spanish mobile application (the "App").

By using the App, you represent that:

You are at least 13 years old, or have parental/guardian consent if under 13
You have the legal capacity to enter into these Terms
You will use the App in compliance with all applicable laws
All information you provide is accurate and current

2. Description of Service

Learn Spanish is an educational mobile application that provides:

Interactive Spanish language lessons from English
Vocabulary building exercises and flashcards
Story-based reading comprehension
Audio pronunciation with native Spanish speakers
Gamification features (XP, gems, hearts, streaks, achievements)
Competitive features (leaderboards, leagues, rankings)
Progress tracking and statistics
In-app virtual currency (gems) earned through lessons and activities
Advertisement-supported content

            Educational Purpose: The App is designed for educational and entertainment purposes. It is a supplemental learning tool and should not replace formal language education or professional instruction.
        

3. User Accounts

3.1 Account Creation

Google Sign-In: You may create an account using Google authentication. By doing so, you authorize us to access certain Google account information as described in our Privacy Policy
Guest Mode: You may use the App without creating an account, but some features (leaderboards, cloud sync, leagues) will be unavailable
Age Requirement: Users under 13 must have parental consent. Users under 13 should use Guest Mode to avoid cloud data collection

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials
Authentication is handled securely through Google Sign-In
You must notify us immediately of any unauthorized use of your account
We are not liable for losses caused by unauthorized use of your account

3.3 Account Termination

You may terminate your account at any time by:

Signing out from the Profile screen
Uninstalling the App
Contacting us to request account deletion

We reserve the right to suspend or terminate accounts that:

Violate these Terms
Engage in fraudulent or abusive behavior
Attempt to hack, cheat, or manipulate the App
Harass or harm other users

4. User Conduct and Prohibited Activities

You agree NOT to:

4.1 Technical Restrictions

Reverse engineer, decompile, or disassemble the App
Modify, adapt, or create derivative works of the App
Remove, alter, or obscure copyright or proprietary notices
Use automated scripts, bots, or tools to interact with the App
Attempt to gain unauthorized access to our servers or databases
Interfere with or disrupt the App's functionality or servers

4.2 Content Restrictions

Upload, post, or transmit malicious code, viruses, or harmful content
Use the App for any unlawful purpose
Impersonate any person or entity
Collect or harvest personal information of other users

4.3 Fair Use

Exploit bugs, glitches, or errors to gain unfair advantages
Manipulate leaderboards or rankings through fraudulent means
Use multiple accounts to circumvent learning mechanics
Sell, trade, or transfer accounts or in-app currency

Violation Consequences: Users who violate these Terms may face account suspension, termination, loss of progress, or legal action if applicable.

5. Virtual Currency and In-App Economy

5.1 Gems (Virtual Currency)

Gems are a virtual currency earned through lessons and activities (lessons, achievements, daily bonuses, ads)
Gems can be spent within the app to purchase virtual items (hearts refill, boosts, power-ups)
No Real Money Purchases: The App does NOT offer in-app purchases for real money. All gems are earned through free lessons and activities
Gems have no real-world monetary value and cannot be exchanged for cash
Virtual items are non-refundable once purchased with gems

5.2 Hearts System

Hearts represent practice attempts within lessons
Incorrect answers reduce hearts
Hearts refill automatically over time (20 minutes per heart)
Users can watch rewarded ads to refill hearts instantly
Users can spend gems (350 gems) to refill hearts

5.3 XP and Levels

Experience Points (XP) are earned by completing lessons and challenges
XP contributes to league rankings and weekly competitions
XP cannot be purchased and is earned solely through completing lessons

6. Leaderboards and Competitions

6.1 League System

Signed-in users compete in weekly leagues (Bronze, Silver, Gold, Diamond)
Rankings are based on weekly XP earned
Top performers are promoted to higher leagues
Bottom performers may be demoted to lower leagues
League resets occur weekly (Sunday night)

6.2 Fair Competition

Leaderboards reflect real user performance
Cheating, manipulation, or artificial ranking inflation is prohibited
We reserve the right to remove fraudulent entries from leaderboards
Disputes regarding rankings are subject to our final decision

6.3 Rewards

Users earn gems based on their final league position
Rewards are virtual and have no cash value
Rewards are distributed automatically after league reset

7. Advertising

7.1 Ad-Supported Model

The App is free to use and supported by advertisements provided by:

Google AdMob (banner, interstitial, native, rewarded ads)
Facebook Audience Network (mediation)

7.2 Types of Ads

Banner Ads: Displayed at top/bottom of screens
Interstitial Ads: Full-screen ads shown between activities
Native Ads: Blended ads within content feeds
Rewarded Video Ads: Optional ads that provide in-app rewards (hearts refill)

7.3 Ad Personalization

Ads may be personalized based on your interests (you can opt out in device settings)
EU users are prompted for ad consent (GDPR compliance)
Ad networks operate under their own privacy policies (linked in our Privacy Policy)

7.4 Third-Party Advertisers

We do not control the content of third-party advertisements
Clicking on ads may redirect you to external websites or apps
We are not responsible for the content, privacy practices, or offerings of advertisers
You interact with advertisers at your own risk

8. Intellectual Property Rights

8.1 Our Ownership

The App and all content, features, and functionality (including but not limited to):

Software code, algorithms, and architecture
Lesson content, exercises, and curriculum
Vocabulary databases and translations
Audio files, images, graphics, and animations
Logos, trademarks, and branding
User interface and design elements

are owned by Morpich Design or our licensors and are protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

Download and install the App on your personal device
Use the App for personal, non-commercial educational purposes

This license does NOT allow you to:

Redistribute, sell, or sublicense the App
Use the App content for commercial purposes
Create derivative works or competing products
Extract or reuse lesson content, audio, or databases

8.3 User-Generated Content

Users may provide display names and profile information
By providing content, you grant us a worldwide, royalty-free license to use, display, and distribute such content within the App
You retain ownership of your content but grant us necessary rights to operate the App

8.4 Third-Party Content

The App uses open-source libraries and third-party components (see Attributions in app)
Audio pronunciations may be sourced from third-party TTS providers
Such content is subject to its respective licenses and terms

9. Privacy and Data Collection

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Key points:

We collect device information, usage data, and analytics
Signed-in users have their progress synced to Firebase Firestore
Guest users have data stored locally only
We use cookies and tracking technologies (Firebase Analytics, AdMob)
Third-party ad networks collect advertising identifiers

10. Disclaimers and Limitations of Liability

10.1 "As-Is" Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Merchantability, fitness for a particular purpose, or non-infringement
Uninterrupted, error-free, or secure operation
Accuracy, completeness, or reliability of content
Results or outcomes from using the App

10.2 Educational Disclaimer

The App is a supplemental learning tool and does not replace formal language education
We do not guarantee fluency, proficiency, or specific learning outcomes
Language learning results vary by individual effort, practice, and aptitude
Content is provided for educational purposes and may contain errors or omissions

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Indirect, incidental, consequential, or punitive damages
Loss of data, progress, or virtual currency
Loss of profits, revenue, or business opportunities
Interruption of service or app unavailability
Third-party actions (advertisers, ad networks, external links)
User errors, misuse, or unauthorized access

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP (WHICH IS ZERO, AS THE APP IS FREE).

10.4 Third-Party Services

We are not responsible for the availability, accuracy, or content of third-party services (Firebase, AdMob, etc.)
Service interruptions caused by third-party providers are beyond our control
We are not liable for privacy practices or security of third-party services

11. Indemnification

You agree to indemnify, defend, and hold harmless Morpich Design, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any third-party rights
Your violation of applicable laws or regulations
Content you provide or actions you take within the App

12. Updates and Modifications

12.1 App Updates

We may release updates, patches, or new versions of the App
Updates may add features, fix bugs, or improve performance
You are responsible for downloading updates to maintain functionality
Continued use of outdated versions may result in reduced functionality

12.2 Content Changes

We reserve the right to modify, suspend, or discontinue any feature or content
Lessons, exercises, or features may be added, removed, or updated
Changes are made at our sole discretion without prior notice

12.3 Terms Updates

We may update these Terms at any time
Material changes will be communicated through in-app notifications or updated "Last Updated" date
Continued use of the App after changes constitutes acceptance of new Terms

13. Termination

13.1 Termination by You

You may stop using the App at any time by:

Uninstalling the App from your device
Signing out and requesting account deletion

13.2 Termination by Us

We reserve the right to terminate or suspend your access immediately, without notice, for:

Violation of these Terms
Fraudulent or illegal activity
Abusive behavior toward other users or our team
Attempts to manipulate or hack the App
Any conduct we deem harmful to the App or its users

13.3 Effect of Termination

Upon termination, your right to use the App ceases immediately
Your progress, virtual currency, and account data may be deleted
Sections of these Terms that by nature should survive termination will remain in effect (e.g., disclaimers, limitations, indemnification)

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Morpich Design operates, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through good faith negotiation
If negotiation fails, disputes shall be resolved through binding arbitration or in courts of competent jurisdiction

14.3 Class Action Waiver

You agree that disputes will be resolved individually and not as part of a class action, consolidated action, or representative action.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Morpich Design regarding the App.

15.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.

15.3 No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce it in the future.

15.4 Assignment

You may not assign or transfer these Terms or your account. We may assign these Terms without restriction.

15.5 Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (natural disasters, server outages, cyberattacks, pandemics, etc.).

15.6 Export Compliance

You agree to comply with all applicable export and import laws when using the App.
